Employees of the Prosecutor General’s office noted the effectiveness of the forest EGAIS System
The Prosecutor General of the Russian Federation on December 19 at a meeting of the Interdepartmental working group on implementation of the legislation on counteraction of crimes and offences in the customs field, the effectiveness of the system, LesEGAIS– unified state automated system of accounting of wood and transactions with it, as reported by the press service of the FFA.
At the meeting of the working group, the representative of the Supervisory authority, the head of the Department for supervision of the customs legislation of the Prosecutor General Mikhail Kuznetsov said that in 2018, 711 criminal cases were initiated on the facts of timber exports with violations of existing laws, 108 of them were transferred to the courts for consideration, on the merits. According to the Prosecutor General’s office, a thorough check of the legality of the origin of wood revealed violations in the activities of the Federal customs service in the design of exported wood. In particular, the facts of exceeding by participants of foreign economic activity (FEA) quotas for the export of wood, non-payment of customs duties, as well as attempts to export wood on forged accompanying documents.
Participants of the meeting of the Interdepartmental working group-deputies of the East Siberian and West Siberian transport prosecutors, representatives of the North-Western and Siberian operational customs noted that the Prosecutor’s supervision and preventive measures help to prevent the criminalization of the situation of timber exports across the state border.
Thanks to the system of Lesegais developed and implemented by the Federal forestry Agency of the Russian Federation, the turnover of harvested wood from the cutting area to the state border becomes transparent, – said the representative of the Supervisory authority. He also noted that Lasegue possible to reduce the burden on law-abiding representatives of forest business without compromising the level of permanent control in General.
The Federal law “about modification of the Forest code of the Russian Federation and the Code of the Russian Federation about administrative offenses”, urged to prevent illegal turnover of wood and to promote creation of conditions for its transparent export, was adopted in 2014, – the head of Department of the analysis of data of EGAIS and accounting of turnover of wood of Management of information systems of Federal forestry Agency Alexey Bobretsov told.
Currently, all transactions of timber and timber primary processing (timber, Board, block), including export, are subject to mandatory registration in the Unified state automated information system of accounting of wood and transactions with it (Lasegue), – said the representative of the Federal forestry Agency. In Lesigues information on the volume of export transactions made by participants of foreign economic activity, ensuring their completeness and accuracy. In the case of non-payment in Lesigues information about the transactions, or entering false information traders are subject to administrative responsibility according to part 1 of article 8.28.1 administrative code.
The decision of the Board of the Eurasian economic Commission came into force on may 26, 2017. Changes were made in “the Instruction about the procedure for filling of the goods Declaration”, under which the organizations-exporters in the Declaration of timber in box 44 “Additional information/submitted documents”, you must specify the number and date of submission of the Declaration on transactions with timber from Lesigues. The staff of the FCS check in Lesigues registered transactions with timber, exported from Russia, when making customs declarations. In addition, the presence of piece marking of exported oak, beech and ash wood is checked by customs officers at checkpoints across the state border of the Russian Federation. To check in, Lasegue of the legal origin of wood exported more than 2.7 thousand employees of the Federal customs service granted access to the system.
In 2018, Lesigues organizations-exporters submitted data on export from the Russian Federation 12.1 million cubic meters of round timber and 21.5 million cubic meters of sawn timber.
