In the Samara region “black woodcutter” will compensate the damage to the state forest Fund in the amount of 300 thousand rubles

According to the press service of Rosleskhoz, the Bogatovsky district court of the Samara region sentenced a citizen who committed at the end of 2018 illegal cutting of three trees of the “oak” breed in the oil and Gas forestry, thereby causing damage to the state forest Fund in the amount of 332 thousand 255 rubles.

For Commission of illegal cutting of forest plantings in especially large size to the citizen found guilty of Commission of the crime provided by part 3 of article 260 of the Criminal code of the Russian Federation punishment in the form of imprisonment for one year is imposed, conditionally.

In addition, the claim of the Ministry of forestry, environmental protection and environmental management of the Samara region for compensation for damage is fully satisfied and now the offender is obliged to compensate the state for the damage in full.

We remind you that for cutting down forest plantations in accordance with article 8.28 of the Administrative Code provides for administrative liability in the form of a fine for citizens in the amount of 3000 to 4000 rubles, for legal entities — from 200 000 to 300 000 rubles. If illegal logging is carried out with the help of special equipment, the monetary penalty increases for individuals from 4000 to 5000 rubles, for legal entities — from 300 000 to 500 000 rubles.

For damage to forestry in a significant amount (more than 5,000 rubles), the offender is prosecuted in the form of a fine of 500,000 rubles, forced labor, correctional labor, and imprisonment for up to two years with a fine.
